General Rental Conditions

- The Owner

- Article 1: Definitions

 

- Owner": Natural or legal person who owns the rented property.

- Tenant": Individual or legal entity that rents the property.

- Property": An object leased between the owner and the tenant.

 

 

- Article 2: Compensation for late payment

 

If the Tenant returns the Property to the Owner after the agreed date or time, the Tenant will pay for the extra days or time at the daily or hourly rental rate plus 10%, unless the delay is the fault of the Owner (e.g. absence from the appointment for handing over the Property). The owner may collect the deposit if the delay exceeds 30 days without the tenant having informed the owner of the delay by registered letter with acknowledgement of receipt.

- Article 3: Deposit                                   

                                                                                                                                                                                                               The deposit must be paid by cheque. This cheque will not be cashed by the owner during the rental period stipulated in this contract. The deposit cheque will be returned to the tenant on return of the property. The owner may only cash the deposit under the conditions set out below:

- If the property is not returned to the owner within 30 days of the scheduled end of the rental period without the tenant informing the owner by registered letter with acknowledgement of receipt.

- If the property is damaged by the tenant and the tenant does not restore the property within 30 days of the scheduled end of the rental period.

- If the property requires special maintenance, the owner may deduct the maintenance costs from the deposit. The owner will then cash the deposit cheque and refund the tenant the amount of the deposit minus the maintenance costs.

 

- Article 4: Damage to property / Theft / Loss

 

Any damage to the property caused by the hirer will be charged to the hirer. The property must be restored within 30 days of the scheduled end of the rental period. The deposit will only be returned to the hirer once the property has been repaired, after deduction of any repair costs, unless otherwise agreed between the owner and the hirer. All equipment offered for hire is deemed to be taken in good condition and must be returned as such. The equipment, being numbered or marked, must be returned with the same numbers and the same mark. Any damage, whatever the cause, will give rise, in addition to the cost of the hire, to payment directly to the Ecole de Surf de la Réunion of the cost of replacement or repair, up to a maximum of the value of the equipment when new. Failure to return the rented equipment, for whatever reason, will result in the Ecole de Surf de la Réunion invoicing the client for the full value of the equipment in new condition at the public sale price, in addition to the cost of the rental.

Carbon paddle: 150 Euros

Rescue gillet: 50 Euros

Watch: 15 Euros

Easy breath: 50 Euros

Parasol: 45 Euros

- Article 5: Liability

 

People renting kayaks, surfboards, bodyboards and stand-up paddle boards on a self-catering basis must be able to swim 25 metres, be at least 16 years old and declare that they have personal liability insurance. The hirer is solely responsible for the property, its use and any damage that may be caused by the property or its use, throughout the rental period and until the property is returned to the owner. The hirer acknowledges that the equipment will be returned to him/her in normal working order with the safety and personal protection equipment appropriate to the craft and the user. The lessee declares that he/she is familiar with the operation and handling of the equipment as well as the risks and precautions to be taken when using the equipment. The lessee undertakes to use the property only for legal purposes and in compliance with the marine reserve and regulations. The owner is released from any liability concerning the property and its use whatsoever until the property is returned by the lessee. The Réunion Surf School is not involved in any way and cannot therefore be held responsible for any damage caused by the property or its use.  

 

- Article 6 : Insurance

 

 

The hirer may take out a French Surfing Federation licence (valid for 1 year): 35 €/pers.

 

- Article 7: Disputes, Courts

 

In the event of a dispute, priority will be given to an amicable solution between the two parties. If no amicable solution is found, the courts of the town of Saint-Denis de la Réunion shall have sole jurisdiction.
